General terms and conditions

Definitions

  1. Yoga with Tiffany: Refers to the company Yoga with Tiffany, located in Amsterdam, registered with the KVK-number 88541614.

  2. Client: The individual or entity entering into an agreement with Yoga with Tiffany.

  3. Parties: Refers collectively to Yoga with Tiffany and the Client.

  4. Consumer: A Client who is a private individual acting outside the scope of their business or profession.

Applicability

  1. These terms and conditions apply to all services by Yoga with Tiffany.

  2. Deviations from these terms and conditions are only valid if agreed upon in writing by both Parties.

Prices

  1. Prices are quoted in euros (€), exempt from VAT, and excluding any possible additional costs, such as traveling costs.

  2. Yoga with Tiffany reserves the right to change the prices of its services and products as displayed on the website or other communications at any given time.

Payments and Payment Term

  1. To confirm your booking for an introductory or single class, Yoga with Tiffany requires an upfront payment. Payments can be made via a payment request (Tikkie) or by invoice.

  2. For class packages, payment can be made either by invoice or payment request. Payment is due before the first class takes place.

  3. Class packages can also be paid in installments. For the 5-class package, payments can be made in two installments with a 2% surcharge on the total price. The first installment is due before the first class, and the second installment before the third class. For the 10-class package, Yoga with Tiffany offers the option to pay in either two or four installments. For the two-installment option, a 2% surcharge applies, with the first payment due before the first class and the second before the fifth class. For the four-installment option, a 5% surcharge applies. Payments are due as follows: the first installment before the first class, the second before the third class, the third before the fifth class, and the fourth and final installment before the seventh class. Each installment must be paid within 7 days.

  4. The payment terms set by Yoga with Tiffany are strict deadlines. Failure to pay by the final day will automatically place the Client in default without the need for a reminder or notice of default.

Consequences of Late Payment

  1. If the Client fails to pay within the agreed term, Yoga with Tiffany may charge statutory interest for non-commercial transactions from the day the Client is in default.

  2. The Client is also liable for extrajudicial collection costs and any damages due to late payment.

  3. Collection costs are calculated according to the “Besluit vergoeding voor buitengerechtelijke incassokosten.”

  4. Yoga with Tiffany may suspend its obligations until the Client has paid in full.

  5. In case of liquidation, bankruptcy, attachment, or suspension of payment, all claims of Yoga with Tiffany against the Client become immediately due.

  6. Refusal by the Client to cooperate with the execution of the agreement does not relieve the Client of their payment obligations.

Cancelation

If a client needs to cancel a scheduled class, they may do so at least 24 hours before the class, and Yoga with Tiffany will work with them to reschedule. However, if the cancellation occurs less than 24 hours before the class, the full price will be charged, and rescheduling will not be possible. Cancellations made at least 48 hours in advance may qualify for a refund. Yoga with Tiffany reserves the right to cancel a class at any time, in which case the client will have the option to reschedule or receive a refund.

Liability

  1. The private yoga sessions provided by Yoga with Tiffany are designed to rebalance the nervous system, promote relaxation, reduce stress, and enhance overall well-being. However, there is no guarantee that the yoga classes will alleviate any specific physical or mental complaints.

  2. If at any time during the session you experience pain or discomfort, it is essential to inform Tiffany immediately so that the practice can be adjusted to meet your comfort level. You agree not to hold Yoga with Tiffany responsible for any pain or discomfort experienced during or after the session.

  3. Yoga with Tiffany provides yoga instruction as a form of holistic well-being practice, not as a substitute for medical treatment. Tiffany is not qualified to perform medical diagnoses, prescribe treatments, or address physical or mental illnesses. Always seek advice from a healthcare professional for any medical concerns.

  4. It is your responsibility to inform Tiffany of any known medical conditions, injuries, or changes in your health status before each session, as certain conditions may require modifications or contraindicate certain yoga practices. Yoga with Tiffany cannot be held liable for any issues arising from undisclosed health conditions.

  5. By participating in the private yoga sessions, you acknowledge and agree to release Yoga with Tiffany from any and all liability related to the yoga instruction provided, both now and in the future.

Execution of the Agreement

  1. When the Client and Yoga with Tiffany enter into an agreement for a service, it only obligates Yoga with Tiffany to make reasonable efforts and does not impose a guarantee of results.

  2. Yoga with Tiffany will execute the agreement to the best of its ability and in accordance with the standards of good workmanship.

  3. The execution of the agreement will occur in consultation and after written approval and payment by the Client.

  4. The Client must ensure that Yoga with Tiffany can begin the execution of the agreement on time.

  5. If the Client fails to ensure that Yoga with Tiffany can start on time, any additional costs resulting from this will be the responsibility of the Client.

Modification of Terms and Conditions

Yoga with Tiffany may modify these terms and conditions. Minor changes can be made at any time. Significant changes will be discussed with the client in advance.
